Called to Order

The regular monthly meeting was called to order at 7:05pm by Chairman Chad Sandey. The Pledge of Allegiance was said.

Due to COVID-19 we are practicing safe social distancing.

 

Minutes

Minutes for the September meeting and Levy Meeting were presented to the Board. Motion to accept the September Meeting Minutes by Bruce, second by Lee, Unanimous at 7:07pm. Motion to accept the Levy Meeting Minutes by Bruce, second by Lee, Unanimous at 7:09pm. Motion to delete the September meetings recordings of minutes by Chad, second by Bruce, Unanimous at 7:09pm.

 

Treasurer’s Report

Treasurer’s Report for September was submitted by Kevin. Kevin moved the 3 expiring CDs at 3% interest to higher interest CDs at 5.28% for 5-month term. Kevin to update spreadsheet to change from 12-month terms to 5 month-terms. Bruce commented the CIP account that we have been saving for is being used on the Sand Creek Drive and Twin Oak Circle repaving project which should be completed this month. Motion to accept the Treasurer’s Report by Bruce, second by Lee, Unanimous at 7:12pm.

Public Comment:  Peggy Jo Dunnette asked if the agenda is ready by the Thursday that the email is sent out to those that have registered to the Sand Creek Township website. Emily and Chad responded that the agenda may change multiple times by the monthly meeting date.

 

State Representative Ben Bakeberg (54b) introduced himself and provided a legislative update with highlights on local projects: Prior Lake and Spring Lake boat ramps, river bank stability in Shakopee, Hwy 282 and CR 9 overpass/intersection funding. He spoke about the very expensive session and a 1% sales tax increase in Scott County. He acknowledged Township Board members Lee Kes and Chad Sandey as being recently inducted into the Jordan High School Hall of Fame (1983 football season). He also thanked the Board for meeting with him to discuss Township needs.

 

BUSINESS/DISCUSSION:

 

Sheriff’s Department: Det. Muelken provided the Sheriff’s Report. It stated there were 54 calls in September, up from 49 calls for August. Calls included: 2 fire (outside), 5 suspicious, 2 animal, 13 traffic, 1 human services, 1 domestic, 3 hazard, 6 accidents, 1 noise complaint, 2 alarm and 3 medical. The Renaissance Festival parking changes and shuttles went well. Jennifer Jensen asked about the shooting in Burnsville. He noted they are still investigating and is unable to provide more information.

 

Prior Lake Spring Lake Watershed District:  Christian Morkeberg reminded attendees that their goal is to improve water quality in streams and lakes. He said their 2024 budget is being worked on and finalized. They hope to not increase taxes. At the next Fish Lake meeting, they will be presenting results to help manage it. Swamp Lake water quality feasibility study to be presented next week, and would like to involve the land owners. The Sutton Lake iron-enhanced sand filter location to be discussed at their next meeting.

 

Stantec: Matt Stordahl provided updates on the following Projects/Topics: Culvert Replacement Projects: Todd Dvorak has ordered pipes. Roundabout Project on Hwy 21: Project is complete and open for traffic. Matt and Kevin to review road maintenance charges to submit to MNDOT for unofficial detours. TH 169 Bluff Drive Overpass Project: We are still waiting on road review and an approval from the railroad. Minor bridge maintenance (snow plowing, street sweeping and storm drain cleaning) is owned by the Township. Major maintenance (re-decking, retaining wall repair, etc.) is currently at 50% Township responsibility. According to MAT (Minnesota Association of Townships), no Townships own major maintenance over a trunk highway in the State of Minnesota. We are working with MNDOT to get that major responsibility down to zero. All project agreements need to be signed before project can be let (open for bidding). Scott County may push out bid until 2024 while we wait for the railroad to respond. Sand Creek Drive and Twin Oak Circle Project: Pavement has been removed and first lift of asphalt went in on Tuesday (October 3rd). Prior Lake Blacktop has requested payment for the work completed so far (reclamation work and driveway cutting). See Monthly Claims section (above). Motion by Chad to approve the first pay request for Sand Creek Drive and Twin Oak Circle, second by Bruce, Unanimous at 7:48pm. Matt is working with Prior Lake Blacktop to finish the driveways. Questions from Residents: Ursula Bedeaux asked Matt about the potholes on Bluff Drive and TH 169. and when will MNDOT fix them. Matt will check with MNDOT.

 

Comp Plan Amendment Discussion: Chad reminded attendees the Township submitted paperwork for a Comp Plan Amendment to Scott County in August to change the zoning from Urban Business Reserve to Rural Business Reserve which will allow for outside storage in the industrial area along Valley View Drive. All jurisdictions have been notified and have 60 days for review and responses (ends October 8th). At the end of the 60 days, a public hearing could be held in November with the Scott County Planning Commission. Residents, businesses, and jurisdictions can comment at the public hearing. The Board of Commissioners could vote on it in December and then send to the Met Council in January if it’s approved as it passes through each phase. Peggy Jo Dunnette asked if the Township will notify residents when the Public Hearing date is determined. Chad said we will let the residents know via email.

 

Camping World Interim Use Permit (IUP): Scott Roltgen (via Zoom) reiterated their effort to rezone a 2.85-acre lot from I-1, Rural Industrial to C-1, General Commercial. This rezoning aligns with their Comp Plan Amendment to combine 4 lots into 1 large lot. The lot is adjacent their existing sales lot and repair facility. The Scott County Staff Report has been reviewed. Motion by Bruce based on the criteria for approval listed in the staff report, I recommend approval of the rezoning of 2.85-acres from I-1, Rural Industrial, to C-1, General Commercial, second by Lee, Unanimous at 8:10pm.

 

JL Theis Conditional Use Permit (CUP): Lee Theis informed attendees their company is in the heavy highway industry, has outgrown their current location and needs outdoor storage space. They acquired the former Greystone building and an adjacent lot from a holding company. They plan to merge the two lots into one larger lot. They will be remodeling the office area and will install larger overhead doors for vehicles. They will have a chain link with slats fencing area for vehicles, trailers, excavators and material piles. Chad explained that a new driveway permit is required from the Township ($1000 escrow). Chad will let Bob Ruppe know a Development Agreement draft is to be sent to Lee. The Scott County staff report has been reviewed. Motion by Bruce based on the criteria for approval listed in the staff report, we recommend approval of the preliminary and final plat of Highway 169 Industrial Park Third Addition and approval of the Conditional Use Permit for JL Theis Inc., to operate a contractor yard, noting that this recommendation is subject to the conditions that must be satisfactorily addressed prior to the County Board consideration of this project including the Developer’s Agreement with some set escrow amount, second by Lee, Unanimous at 8:39pm.

 

Bridge Maintenance Responsibility: Chad explained that MNDOT is taking ownership of the Bluff Drive bridge. Chad to notify Bob Ruppe about a future maintenance agreement.

 

Ridges Liquor License Resolution: Motion by Chad that we approve the Resolution for the renewal of the liquor license out at Ridges of Sand Creek for the 2024 year, second by Bruce, Unanimous at 9:00pm.

 

CIP Updates: Bruce explained pipes for culverts at Harlow & 165th and for Naylor have been ordered by Todd Dvorak. Todd said they are ready to be picked up. Need quotes from Todd for replacing the culverts. It has been decided that we will be using our ARPA funds in Road & Bridge. Matt made suggestions about repairs/replacement for culvert on 173rd Street West (top of hill). Lee and Todd discussed cleaning up trees in right of way (easement).

 

Website Update: Bruce sent Emily pictures from Twin Oak Circle project and Sand Creek Drive progress and from newly paved approach by MNDOT on Hwy 21 off of 210th Street. These pictures will be added to the website. Task List: Emily asked and Chad ok’d to add the By The Yard pond maintenance agreement to the Task List.

 

REPORTS/DISCUSSIONS:   

 

Lee Kes Road Report: Lee reported road topics were already discussed during CIP.

 

Bruce Hunstad: Bruce reported attending SCALE pilot program between Police and Sheriff’s departments and counselors to coordinate on calls. He also attended the executive board meeting for TH 169 Corridor Coalition.

 

Chad Sandey:  Chad attended County Commissioners board meeting and noted the enforcement strategies and reporting to Townships. Maggie mentioned the memorial which has a handrail and steps on Valley View Drive is in the right-of-way and will affect snow plowing. She spoke to someone who was at the memorial to warn them of upcoming potential damage. Planning Commission meeting is scheduled for Monday, November 13th. Will find out when the public hearing will be held.
